This Privacy Policy governs any personal information of any user (“Your” or “You”) that is collected, used or processed by HackerEarth Inc. and its affiliates (“HackerEarth”, “we”, “our” or “us”) on our website hackerearth.com and all the subdomains under hackerearth.com. (“Site”) or while using our services, products or any applications developed or created by us (collectively, "Services").

This Privacy Policy details our commitment to protecting Your privacy and ensuring that You have a positive experience on our Site. "Personal Data" in this Privacy Policy means any information that can be used to personally identify a person and may include, but is not limited to, name, email ID, postal or other physical addresses, title, and other Personally Identifiable Information (“PII”).

  1. Collecting Your Personal Data

    1. Personal Data collected by us:

      Based on how the Site is accessed and the way the Services are used, we collect Your Personal Data as follows:

      1. When You access the Site on Your own accord for personal reasons:

        • Name (first name/last name/full name);
        • Title;
        • Email ID (both personal and professional).
      2. When You have been granted access to the Site by our existing customer, the customer may choose to collect the additional details but not limited to the the below to use our Services:

        • Profile/display picture;
        • E mail ID (both personal and professional)
        • Country, state, postal code, or city of residence;
        • Login name, screen name, nickname, or handle;
        • Telephone number (home/work/mobile number);
        • Postal or other physical addresses;
        • Date of birth;
        • Gender;
        • Name(s) of the school/university (including grades and graduation year);
        • Name(s) of the workplace;
        • Job position/designation (including salary);
        • Resume/CV;
        • Information related to social profiles, such as Facebook, Google, GitHub, etc.

        In the case above, HackerEarth as a Data Processor permits its customer(s) as a Data Controller, to collect any supplementary information it chooses to. Your consent shall be explicitly sought before collecting any additional Personal Data. You may choose not to provide the Personal Data requested. However, You may not be able to access certain options, offers, and Services if You have not provided Your Personal Data.

    2. Personal Data automatically collected by us:

      When You use the Services in the below manner (“Usage Information”):

      • Account registration;
      • Use of certain Service features;
      • Creating or taking tests;
      • Generating reports based on information collected from use of our Services;
      • Requesting Service and support for our Services;
      • Registering for an event (challenge, hackathon, etc.);
      • Participating in an online survey;
      • Participating in discussion groups or forums;
      • Registering for newsletter subscriptions;
      • Customizing the content based on relevance.

      We automatically collect Personal Data, using methods such as cookies and tracking technologies (further described below). Data that is automatically collected includes cookies, page-view activity, geolocation data, Internet Protocol (IP) addresses, browser type, Internet Service Provider (ISP), referring/exit pages, files viewed on our Site (e.g., HTML pages, graphics, etc.), operating system, date/time stamp, and/or clickstream data to examine trends in the aggregate and administer the Site and/or Services. Such data does not have an expiry date and we don't delete this data. It is saved with us in log form or on tools such as Google Analytics, LinkedIn Insights, Facebook Audience Insights, and more.

      Additionally, when You use some of our Services, network information such as product or Service usage details are transmitted back to us. This is done for us to determine how users are interacting with our Services. This helps us in improving our Services and correcting any problems that may occur. We use information received from Google APIs with adherence to the Google API Services User Data Policy, including the limited use requirements.

  2. Cookies and Tracking Technologies

    We use cookies or similar technologies to analyze trends, administer the Site, track users’ movements around the Site, and gather information about the user base, such as location information based on IP addresses. Users can control the use of cookies in their respective browsers. Our Services do not support Do Not Track requests. When using our Services, information about Your online activity will be collected while and after You leave our Site.

    Certain features of our Services depend on cookies and plugins. Please be aware that if You choose to block cookies and plugins, You may not be able to sign in or use those features. Preferences controlled by those cookies, including advertising preferences, will be deleted and may need to be recreated.

    We collect information related to visitors and machines. Such information includes cookies, IP addresses, page-view activities, and geolocation data.     Interest-based Advertisements

    We use cookies to examine Your browsing activity and interest on the Site to provide personalised advertisements. We also partner with third parties to either display advertising on the Site or to manage our advertising on other sites. Some of our third-party partners may use cookies to gather information about Your browsing activities and interests on the Site, our affiliates’ websites, and unaffiliated websites to provide You with customised advertisements.

    Mobile Application

    When You download and use our Services, we automatically collect information about the type of device You use, operating system version, and the device identifier (or UDID). This is done to send You push notifications regularly or send You updates about events and promotions that we may be running. If You no longer wish to receive this type of communication, You can turn the notifications ‘off’ on Your device.

    Geolocation

    When You use our Services, we collect information about Your location. This information is used for optimizing Your connection to our data center and suggesting customizations to Your experience with our Services (e.g., Your language preference, relevant events, challenges, hackathons, and more). We share this information with third parties such as our cloud service provider. If You wish Your information, not be shared in this manner, You may opt-out by contacting us at support@hackerearth.com.

    However, certain features of Services depend on geolocation. If You choose to block Your geolocation identity, You may not have optimal experience on the Site and You may not be able to sign in or use those features and preferences that are dependent on geolocation.

  3. Processing Your Personal Data

    We will use Your Personal Data only in accordance with this Privacy Policy. If You do not wish for us to continue using Your Personal Data, You can request that Your account be deactivated from Your profile settings.

    We will only process Your Personal Data if we have a lawful basis for doing so, which includes, but is not limited to, the following: consent, contractual necessity (i.e. processing that is necessary for the performance of a contract with You, such as Your user agreement with us that allows us to provide You Services), and our legitimate interests or the legitimate interest of others (e.g. our users) such as:

    • Personalizing, improving, or operating our Services and business;
    • Understanding Your needs and interests;
    • Fulfilling Your requests related to our Services;
    • Providing You with relevant information;
    • Complying with our legal obligations, resolving disputes with users, and enforcing our agreements;
    • Protecting, investigating, and deterring against fraudulent, harmful, unauthorized, or illegal activities;
    • Providing reports based on information collected from use of Services;
    • Keeping You up-to-date about latest Services announcements, software updates, software upgrades, system enhancements, special offers, and other information;
    • Providing support and assistance for our Services;
    • Providing the ability to create personal profile;
    • Providing the ability to contact You, if required;
    • Providing customer feedback and support;
    • Providing and administering opt-in events or other marketing or promotional activities;
    • Being able to conduct surveys in order to provide You with better products and services;
    • Supporting recruitment inquiries;
    • Personalizing marketing communication and website content based on Your preferences such as in response to Your request for specific information on products and Services that may be of interest to You;
    • Meeting contractual or legal obligations.
  4. Invites

    If You choose to use our ‘Invite Service’ to tell a friend about our Services, You represent that You have Your friend’s consent to give us their name and email ID. We will automatically send Your friend a one-time email inviting them to visit the Site. Unless otherwise authorized by Your friend, we will only use Your friend’s name and email ID for the purpose of sending them this one-time email and maintaining an activity log of our referral program.

  5. Your Choice

    You can choose whether to provide Personal Data to us. However, You may not be able to access certain options, offers, and Services if You have not provided Your Personal Data. You can sign up, and therefore consent to receiving emails or newsletters from us. If You would like to discontinue receiving this communication, You can unsubscribe by using the Unsubscribe link at the end of such emails or write to us at support@hackerearth.com.

  6. Your Rights

    You have certain rights with respect to Your Personal Data. Please note that under certain circumstances, we may not be able to fully comply with Your requests without reviewing the same or we may ask You to provide additional information in accordance with Your request. For example, if we need to verify Your identity or the nature of Your request, we may request for additional Personal Data. In such situations, we will respond to let You know our decision.

    • Right to Access: You can request a copy of Your Personal Data that was collected by us.
    • Right to Rectification: If You believe that any Personal Data we are holding about You is incorrect or incomplete, You can request that we correct or supplement it. You can also correct some of this information directly through Your user profile or profile/account settings after logging into account on the Site. Please contact us as soon as possible upon noticing any inaccuracies or incomplete information.
    • Right to Objection: You can contact us to let us know that You object to the collection or use of Your Personal Data for certain purposes.
    • Right to Erasure: You can request that we delete some or all Your Personal Data from our systems. While this will be done immediately, residual data may be saved in certain logs, and this will be purged within a year of deleting Your data. Once Your data is purged, You will no longer have an account with us.
    • Right to Restrict Processing: You can always request us to deactivate Your account to restrict further processing of Your Personal Data.
    • Right to Data Portability: You have the right to ask for a copy of Your Personal Data in a machine-readable format.
    • Right to Refuse or Withdraw Consent: If we are processing Your Personal Data based on Your consent (as indicated at the time of collection of such data), You have the right to withdraw Your consent at any time. Please note, however, that if You exercise this right, You may have to then provide express consent on a case-by-case basis for the use or disclosure of certain Personal Data of Yours, if use or disclosure is necessary to enable You to use some or all of our Services.
    • Right to file a Complaint: You have the right to lodge a complaint about our practices with respect to Your Personal Data with the supervisory authority of Your country or EU Member State.
  7. Data Retention

    Your data is retained until You have an account with us. You can request that we delete some or all of Your Personal Data from our systems. While this will be done immediately, residual data may be saved in certain logs and this will be purged within thirty (30) days of deleting Your data. Once Your data is purged, You will no longer have an account with us.

  8. Sharing Your Personal Data

    We do not share, rent, or sell Your Personal Data to third parties unless You have granted us explicit permission to do so. We share Personal Data within HackerEarth, its affiliated companies, and with third-party service providers for data processing or storage. Personal Data is shared with business partners, service vendors, and/or authorized third-party agents or contractors to provide the requested Services, including but not limited to, hosting websites, hosting events and seminar registrations, and providing customer support.

    In some cases, we may choose to buy or sell assets. In these types of transactions, user information is typically one of the transferred business assets. Moreover, if we, or substantially all of our assets, were acquired, or if we go out of business or enter bankruptcy, user information would be one of the assets that is transferred or acquired by a third-party. You acknowledge that such transfers may occur and that any acquirer of us or our assets may continue to use Your Personal Data as set forth in this Privacy Policy. As required by law, we may respond to subpoenas, court orders, or similar legal processes by disclosing Your Personal Data and other related information, if necessary. We also may use Personal Data and other related information to establish or exercise our legal rights or defend ourselves against legal claims.

    We collect and possibly share Personal Data and any other additional information available to us to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms of Service, or as otherwise required by law.

  9. Security of Your Personal Data

    We are committed to protecting the Personal Data shared with us. We utilize a combination of industry-standard security technologies, procedures, and organizational measures to help protect Your Personal Data from unauthorized access, use, or disclosure.   10. Linked Websites and Third-Party Services

    Our Site and Services may provide links to other third-party websites and services that are outside our control and not covered by this Privacy Policy. When information is collected on our behalf exclusively, this Privacy Policy will be referenced and will govern how Your Personal Data is used. For other, non-HackerEarth sites or services, the site/service owner's privacy policy will be referenced. You should review such third party’s privacy and security policies prior to use.

  11. Forums/Newsgroups

    If You participate in a discussion forum or message, You should be aware that the information You provide on the Site will be made broadly available to others (potentially inside or outside HackerEarth), who have access to that discussion forum or message. Also, please recognize that individual forums and messages may have additional rules and conditions. Each participant's opinion on a forum or chat room is their own and should not be considered as reflecting our opinion.

  12. Children

    We do not knowingly collect or solicit any Personal Data or PII from anyone under the age of 16. In the event that we learn that we have collected Personal Data or PII from a child under age 16, we will delete that information as quickly as possible. If You believe that we might have any information from or about a child under 16, please write to us at the contact information provided below.

  13. Do Residents of California have Specific Privacy Rights?

    If You are a resident of California, You are granted specific rights regarding access to Your Personal Data. You may submit Your request in writing to support@hackerearth.com.

    If You are under 18 years of age, reside in California, and have registered on the Site, You have the right to request removal of unwanted data that You publicly post on the Site. To request removal of such data, please contact us at support@hackerearth.com, and include the email address associated with Your account and a statement that You reside in California. We will make sure the data is not publicly displayed on the Site, but please be aware that the data may not be completely or comprehensively removed from all our systems (e.g., backups, etc.).

    • CCPA privacy notice

      The California Code of Regulations defines a "resident" as:

      1. Every individual who is in the State of California for other than a temporary or transitory purpose;
      2. Every individual who is domiciled in the State of California and is outside the State of California for a temporary or transitory purpose.

    • Will Your Personal Data be shared with anyone else?

      We may disclose Your Personal Data with our service providers pursuant to a written contract between us and each service provider. Each service provider is a for-profit entity that processes the information on our behalf. We may use Your Personal Data for our own business purposes, such as for undertaking internal research for technological development and demonstration. This shall not be considered to be "selling" of Your Personal Data. We have not disclosed or sold any Personal Data to third parties for a business or commercial purpose in the preceding 12 months nor will we sell personal information in the future belonging to the Site visitors, users, and other consumers.

    • What are Your rights with respect to Your Personal Data:

      You have the following rights with respect to Your Personal Data:

      1. Right to request deletion of Personal Data

        You can ask for the deletion of Your Personal Data. If You ask us to delete Your Personal Data, we will respect Your request and delete Your Personal Data, subject to certain exceptions provided by law, such as (but not limited to) the exercise by another consumer of their right to free speech, our compliance requirements resulting from a legal obligation, or any processing that may be required to protect against illegal activities.

        Depending on the circumstances, You have a right to know the following:

        • The categories of Personal Data that we collect;
        • The purposes for which Personal Data is used;
        • Whether we sell Your Personal Data;

        In accordance with applicable law, we are not obligated to provide or delete consumer information that is de-identified in response to a consumer request or to re-identify individual data to verify a consumer request.

    • Right to non-discrimination for the exercise of a consumer’s Privacy Rights

      We will not discriminate against You if You exercise Your privacy rights.

    • Verification process

      Upon receiving Your request, we will need to verify Your identity with our records internally. These verification efforts may require You to provide information which can be confirmed with the information that is already present in our records, or we may contact You through a communication method (e.g., phone or email) that You have previously provided us. We may also use other verification methods as the circumstances dictate. We will only use Personal Data provided in Your request to verify Your identity or authority to make such request. To the extent possible, we will avoid requesting additional information from You for the purposes of verification. If we cannot verify Your identity from the information already maintained by us, we may request that You provide additional information for the purposes of verifying Your identity and for security or fraud-prevention purposes. Upon verification, we will delete such additionally provided information.

    • Other privacy rights

      • You may object to the processing of Your Personal Data;
      • You may request correction of Your Personal Data, if it is incorrect or no longer relevant or ask to restrict the processing of Personal Data.
      • You can designate an authorized agent to make a request under the CCPA on Your behalf. We may deny a request from an authorized agent that does not submit proof that they have been authorized to act on Your behalf in accordance with the CCPA.

      You may request to opt-out from future selling of Your Personal Data to third parties by writing to us at the information provided below. Upon receiving a request to opt-out, we will act upon the request as soon as feasibly possible, but no later than 15 days from the date of the request submission.

  14. Do Residents of the European Economic Area ("EEA”), United Kingdom ("U.K”) and Switzerland have Specific Privacy Rights?

    The following rights under the EU’s General Data Protection Regulation (“GDPR”) are in addition to the rights provided under this Privacy Policy. GDPR is designed to give EU citizens more control over their data. It aims to use an all-encompassing privacy and security law to safeguard Personal Data. Irrespective of their location, GDPR applies to all the relevant controllers or processors who deal with the Personal Data of EU citizens. In the event of conflict, the rights stated hereunder prevail with regard to the processing of Personal Data from EEA, U.K, Switzerland to the extent applicable.

    HackerEarth, Inc. is the Controller (for the purposes of the GDPR) of Your Personal Data that You provide via our product. When providing HackerEarth services for our Customers, HackerEarth is the Data Processor (for the purposes of the GDPR) of Your Personal Data provided by and on behalf of the Customer, who is the Data Controller.

    • What are Your rights with respect to Your Personal Data:

      You have the following additional rights with respect to Your Personal Data:

      1. Right to File a Complaint

        In compliance with the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF, we commit to cooperate and comply respectively with the advice of the panel established by the EU data protection authorities (DPAs), the UK Information Commissioner’s Office (ICO) and the Gibraltar Regulatory Authority (GRA), and the Swiss Federal Data Protection and Information Commissioner (FDPIC) with regard to unresolved complaints concerning our handling of personal data received in reliance on the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF.

      2. Right to Not be Subjected to Automated Decision Making

        Your Personal Data is not subject to automated decision making as envisioned under GDPR. If there are any changes, You will be notified of the same.

      HackerEarth does not capture any HR data. This data comprises details about any aspects of a person or HR management system. Examples of HR data are legal records, health records, and so on. However, we do capture non-HR data such as name, title, email ID, and so on.

  15. Do Residents of Other Regions have Specific Privacy Rights?

    1. United Kingdom:Personal Data collected, stored, used, and/or processed is in compliance with the obligations under UK Data Protection Act 2018, as amended by the Data Protection, Privacy and Electronic Communications (Amendments etc.) (EU Exit) Regulations 2019, as amended, and replaced by (“U.K. GDPR”).

    2. Canada:Personal Data collected, stored, used, and/or processed is in compliance with the obligations under as defined in the Personal Information Protection and Electronic Documents Act.

    3. Singapore:Personal data collected, stored, used and/or processed is in compliance with the Personal Data Protection Act 2012.

  16. Changes to Privacy Policy

    This Privacy Policy may be updated from time-to-time for reasons such as operational practices or regulatory changes. Hence, we recommend that You review our Privacy Policy regularly. You are bound by the updated Privacy Policy.
